Roe v. Wade almost overturned in 1992; blame Kennedy

Roe v. Wade, the landmark Supreme Court decision that effectively legalized abortion on demand. His papers, held by the Library of Congress, are to be released today. NPR got an advance copy, and is reporting as of four hours ago that the 1992 case of Planned Parenthood v. Casey, still in our memories, might have eviscerated, rather than strengthen, Roe.
Planned Parenthood v. Casey was the Bush (41) administration’s big push to overturn Roe. Justices Byron White, Antonin Scalia, Clarence Thomas, and Anthony M. Kennedy were to vote with Chief Justice William H. Rehnquist to rule against Planned Parenthood and overturn the 20 year green-light on abortion. Kennedy backed out at the last minute, to vote with Justices Sandra Day O’Connor, David Souter, and, of course, Blackmun.
The record does not indicate why Kennedy backed out. Some are already suggesting that Souter and O’Connor blackmailed him into a compromise position.
